These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FlatAdda.in ("Company," "we," "us," or "our"), the owner and operator of the website www.flatadda.in, mobile applications, and all related services (collectively, the "Platform").
By accessing, browsing, registering, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and Community Guidelines. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.

1.2 "User" means any individual, entity, or organization that accesses or uses the Platform.
1.3 "Listing" means any property advertisement, including but not limited to residential properties, commercial properties, land, plots, PG accommodations, co-living spaces, rental properties, and any other real estate-related content posted on the Platform.
1.4 "Seller" means any User who posts a Listing for sale, rent, or lease.
1.5 "Buyer" means any User who views, inquires about, or expresses interest in a Listing.
1.6 "Content" means all text, images, photographs, videos, documents, reviews, comments, messages, and any other material uploaded, posted, or transmitted through the Platform.
1.7 "User-Generated Content" or "UGC" means any Content posted by Users, including Listings, messages, reviews, and comments.
1.8 "Intermediary" shall have the meaning ascribed under Section 2(1)(w) of the Information Technology Act, 2000.

2.1 You must be at least 18 (eighteen) years of age and legally competent to enter into a contract to use this Platform. The Platform is not intended for use by minors.
(a) All information provided by you is true, accurate, current, and complete;
(b) You will maintain and promptly update your account information;
(c) You have the legal capacity to enter into these Terms;
(d) You are not impersonating any person or entity;
(e) You are not prohibited from using the Platform under applicable law.
2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.4 You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2.5 We reserve the right to suspend, terminate, or restrict your account at our sole discretion, without prior notice, if we believe you have violated these Terms.

3.1 FlatAdda.in is an intermediary platform that facilitates the connection between property owners, agents, builders, and potential buyers/tenants. We are NOT a party to any transaction between Users.
3.2 In accordance with Section 79 of the Information Technology Act, 2000, we are not responsible for any User-Generated Content posted on the Platform. The responsibility for the accuracy, legality, and appropriateness of any Listing or Content rests solely with the User who posted it.
(a) Own, buy, sell, or rent any property listed on the Platform;
(b) Act as a real estate agent, broker, or consultant;
(c) Guarantee the accuracy, completeness, or legality of any Listing;
(d) Verify the identity of all Users;
(e) Inspect or validate any property listed;
(f) Guarantee the availability or condition of any property;
(g) Participate in any negotiations between Users;
(h) Handle any payments between Users.
3.4 Users are solely responsible for conducting their own due diligence, verifying property details, inspecting properties, and assessing the credibility of other Users before entering into any transaction.

(a) Post any false, misleading, fraudulent, or inaccurate information;
(b) Post any Content that is obscene, pornographic, sexually explicit, defamatory, libelous, threatening, abusive, harassing, hateful, or otherwise objectionable;
(c) Post any Content that infringes upon the intellectual property rights of any third party;
(d) Impersonate any person, entity, or organization;
(e) Use the Platform for any illegal, unlawful, or unauthorized purpose;
(f) Post duplicate listings for the same property;
(g) Post listings for properties you do not have the legal right to sell or rent;
(h) Use the chat functionality for spam, phishing, harassment, or any abusive communication;
(i) Attempt to circumvent any security measures of the Platform;
(j) Scrape, crawl, or use automated tools to extract data from the Platform;
(k) Upload any malware, viruses, or harmful code;
(l) Engage in any activity that disrupts or interferes with the Platform's operation;
(m) Misrepresent the price, condition, or availability of any property;
(n) Contact other Users for purposes other than legitimate property inquiries;
(o) Use the Platform to promote any other business or service;
(p) Collect or harvest personal information of other Users without their consent;
(q) Share contact details of other Users without their explicit permission;
(r) Post any Content that promotes discrimination based on religion, caste, gender, sexual orientation, or disability;
(s) Violate any applicable law, regulation, or ordinance.

5.1 Users posting Listings are solely responsible for the accuracy, completeness, and legality of the Content.
(a) You are the legal owner or authorized representative of the property;
(b) You have the right to sell, rent, or lease the property;
(c) The information provided is true and accurate;
(d) The photographs and videos are genuine and current;
(e) You have obtained all necessary permissions and approvals.
(a) Review, moderate, edit, or remove any Listing;
(b) Reject or approve any Listing at our sole discretion;
(c) Mark any Listing as verified, unverified, pending, or rejected;
(d) Report any suspicious Listing to appropriate authorities.
5.4 We do not endorse, warrant, or guarantee any Listing posted on the Platform.
5.5 Listings may be subject to administrative review before being published. We may take up to [X] hours/days to review and approve Listings.

6.1 Users may choose to share their contact information (phone number, email) on their Listings.
6.2 By sharing your contact information, you acknowledge and accept the risks associated with making your contact details publicly available.
(a) Any misuse of contact information by other Users;
(b) Any harassment, spam, or unwanted communication you may receive;
(c) Any crime or harm resulting from the disclosure of your contact information;
(d) Any offline interactions between Users.
6.4 Users who access contact information of other Users agree to use it solely for legitimate property-related inquiries and not for any unlawful or harassing purpose.

7.1 The Platform provides a chat feature for Users to communicate with each other.
7.2 Users agree to use the chat feature solely for legitimate property-related discussions.
(a) Sending abusive, threatening, or harassing messages;
(b) Sending spam or unsolicited commercial messages;
(c) Sending pornographic, obscene, or sexually explicit content;
(d) Phishing or attempting to obtain personal information fraudulently;
(e) Sharing malware, viruses, or harmful links;
(f) Any communication that violates applicable law.
(a) Monitor, review, or intercept chat messages for quality and safety purposes;
(b) Suspend or terminate chat access for Users who violate these Terms;
(c) Report illegal chat content to appropriate authorities.
7.5 We are NOT responsible for the content of chat messages exchanged between Users.

8.1 Users are strictly prohibited from using the Platform for any fraudulent or illegal activity.
(a) Posting fake or non-existent property listings;
(b) Collecting advance payments for non-existent properties;
(c) Phishing for personal or financial information;
(d) Identity theft;
(e) Money laundering;
(f) Any activity that violates the Indian Penal Code, 1860 or any other applicable law.
8.3 If you suspect any fraudulent activity on the Platform, please report it immediately to support@flatadda.in.
8.4 We will cooperate with law enforcement authorities in investigating and prosecuting illegal activities.
8.5 We are NOT responsible for any loss, damage, or harm resulting from fraudulent activities by Users.

9.1 All intellectual property rights in the Platform, including but not limited to the design, logo, software, database, and all Content (excluding User-Generated Content), are owned by or licensed to FlatAdda.in.
9.2 You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.
9.3 By posting Content on the Platform, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable, transferable license to use, reproduce, modify, adapt, publish, translate, and display your Content for the purpose of operating and promoting the Platform.
9.4 You represent and warrant that you own all rights to the Content you post and that it does not infringe upon the rights of any third party.

(c) Legality of any transaction;
(d) Availability of the Platform;
(e) Security of the Platform;
(f) Fitness for a particular purpose;
(g) Non-infringement;
(h) Reliability of any information provided.
10.3 WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

(a) Any direct, indirect, incidental, special, consequential, or punitive damages;
(b) Any loss of profits, revenue, data, or goodwill;
- Transactions between Users;
- Misrepresentation in Listings;
- Fraudulent activities by Users;
- Offline meetings between Users;
- Criminal activities by Users;
- Use or misuse of contact information;
- Chat communications between Users;
- Any Content posted by Users;
- Errors or inaccuracies in Listings;
- Technical issues or downtime;
(d) Any loss or damage exceeding the amount of ₹1,000 (Indian Rupees One Thousand Only).
11.2 Users acknowledge that they use the Platform at their own risk.
